Terms of Service

To fully use advanced features on NDHGift, you need to create a valid member account:

• You commit to providing accurate, truthful registration information and updating it immediately upon any change (especially the email address for receiving transaction notices and OTP).
• You are responsible for securing your personal account, password, and email OTP verification codes. All actions performed under your login credentials are presumed to be conducted by you.
• You commit to immediately notifying the NDHGift support team if you detect signs of account compromise, password exposure, or fraudulent activity.
• Quick Login Links (OAuth Google/Facebook): The system supports login linked with Google and Facebook accounts. By using this method, you agree to comply with third-party providers' own terms of service.
• Unlink Account: You have the right to unlink your Google or Facebook account at any time in Profile Settings. After unlinking, linked information will be unlinked within 7 working days and removed from NDHGift's authentication system.

NDHGift uses an internal digital wallet mechanism to activate gift plans, special effects, and advanced customizations:

• Currency & Listed Prices: All transactions on the system are denominated in Vietnamese Dong (VND). Fees for duration plans, effects, and utilities are displayed publicly and transparently before payment.
• Wallet Balance Policy (Non-refundable): Funds successfully credited to NDHGift wallets are intended for service usage on the platform and cannot be withdrawn to bank accounts or converted to cash, except for duplicate charge errors verified by our technical team.
• Processing top-up bank transfers via QR code: When topping up by bank transfer via VietQR code, the system will automatically credit your wallet balance within 1 to 3 minutes if transferred with the correct payment code and amount.
• Support for wrong payment syntax or pending transfers: If you transfer the wrong amount, enter incorrect transfer remarks, or bank processing is delayed: Please contact Customer Support via the Support page with proof of successful transfer. Our technical team will manually reconcile and credit your balance within 24 business hours.
• Discount Code (Coupon): Coupons must be applied before confirming gift creation payment. Each coupon has specific validity conditions and usage limits per promotion.

Each digital gift created on NDHGift is associated with a Gift Duration Plan:

• Standard Duration Plans: NDHGift provides flexible display duration plans: 7-day Plan (Free), 15-day Plan, 30-day Plan, 90-day Plan, and Forever Plan. The duration starts from successful payment or from the scheduled release time (scheduled_at) if scheduled ahead.
• Expired Status: When the plan duration ends, the gift link /gift/{slug} will automatically change to suspended display (Expired). Recipients accessing after this point will receive an expiration notice.
• Service Extension Mechanism: You can extend or upgrade the gift's duration plan at any time in Gift Management. After expiration, the system reserves the gift data for the next 30 days so you have the opportunity to restore it before resource cleanup.
• Forever Plan (Lifetime): The gift is displayed continuously without time limit throughout the operating lifecycle of the NDHGift platform.
• Gift Privacy Lock: You have the right to proactively turn the Access Lock (toggle-lock) on or off for your gift. When the gift link is public, anyone with the link can view it, and you have full control over managing this link.

Strict copyright and intellectual property regulations applied on NDHGift:

• Exclusive Assets of NDHGift: All source code, software structure, UI designs, logos, icons, Gift Templates, Gift Effects, and built-in music are exclusive intellectual property of NDHGift.
• Personal Use Rights: You are granted the right to use these gift templates for personal, non-commercial purposes. Copying interface source code, extracting graphics, redistributing, or operating similar commercial services in any form is strictly prohibited.
• Copyright of Uploaded Images & Music: For images, audio files, and videos you upload to design gifts: You warrant and assume full legal liability for ownership or lawful rights. NDHGift bears no joint liability for resulting copyright disputes.
• Copyright Infringement Notice & Takedown Process: If you are the lawful copyright owner and discover infringing content on NDHGift, please submit a violation notice with proof of ownership to the legal department via the Support page. We will verify and take down the infringing content within 48 to 72 business hours.

When sharing posts, uploading illustrations, or leaving comments in the Community Ideas section (/apps/ideas), you agree to comply with:

• Content Cultural Standards: Post and comment content must be constructive, civil, and relevant to gift creation and gratitude topics. Posting spam ads, classifieds, affiliate links, or malicious URLs is strictly prohibited.
• NDHGift's Moderation Right: The administrator reserves the right to moderate, hide, edit tags, or permanently remove posts, images, and comments that violate community standards without prior notice.
• Granting Display Rights: By posting publicly in the Ideas section, you agree to grant NDHGift a non-exclusive, royalty-free license to store, display, and showcase that post to the member community.

The Experience Points (XP) system, User Levels, and Quests are designed to encourage user engagement:

• Non-monetary Nature: Experience Points (XP), member levels, and honors have internal symbolic value within the NDHGift platform. XP points have NO cash conversion value, cannot be withdrawn to bank accounts, and cannot be transferred between accounts.
• Prohibition of Point Farming Fraud: Any use of automated tools (bots, auto-clickers, scripts) or exploiting system bugs to farm XP points or spam quest rewards is strictly prohibited. Upon violation, NDHGift reserves the right to revoke fraudulent points, downgrade levels, or permanently ban accounts.
• Anonymous Mode on Leaderboard: You have the full right to turn on or off the anonymous display feature (toggle-anonymous) in Profile Settings to protect your ranking privacy.

When using any NDHGift services, you strictly commit not to perform the following actions:

• Creating gifts or posting content of pornographic, obscene, violent, terrorist nature, inciting hatred, discrimination, or acting against the State of the SRV.
• Insulting honor, dignity, slandering, or threatening others through gift messages or community forums.
• Using tools to tamper with source code or sending illicit requests to alter wallet balances, bypass payment, or exploit system resources.
• Impersonating other individuals, state authorities, or reputable brands for fraudulent purposes or seizing recipient assets.
• Distributing files containing viruses, malware, Trojan horses, or using gift links to conduct phishing attacks.

NDHGift reserves the right to suspend or terminate services in violation cases:

• Locking Violating Accounts: If you breach any terms of this Agreement, we reserve the right to suspend services or permanently lock your account without prior notice. Existing wallet balances in violating accounts will be voided and non-refundable.
• Exemption from force majeure technical incidents: NDHGift strives to maintain 24/7 system availability but is not liable for service interruptions caused by widespread undersea cable cuts, natural disasters, uncontrollable cyberattacks, or pre-announced server maintenance.
• Exemption from personal disputes between sender and recipient: NDHGift acts as an intermediary gift creation tool provider. We are fully exempt from any legal liability regarding personal conflicts, emotional harm, or romantic and financial disputes arising between gift creators and recipients.

This Terms of Service Agreement is governed and construed in accordance with the laws of the Socialist Republic of Vietnam:

• Any disputes or complaints arising during service use will initially be resolved through good-faith negotiation and equal mediation between the parties.
• The timeframe for receiving and resolving complaints is within 30 days from the occurrence date.
• If negotiations fail to reach an agreement, the dispute will be brought to the competent People's Court in Hanoi, Vietnam. The court's judgment is final and binding on all parties.
